What is ESOS?
The Energy Savings Opportunity Scheme (ESOS) is a mandatory energy assessment scheme for large UK organisations, administered by the Environment Agency. Qualifying businesses are required to:
Measure total energy consumption across buildings, transport, and industrial processes
Carry out detailed energy audits to identify cost-effective savings
Submit a compliance notification to the Environment Agency every four years
ESOS applies across the UK and is currently in Phase 4, with a compliance deadline of 5 December 2027.
Do I need to comply with ESOS?
Your organisation is required to participate in ESOS if, on the qualification date of 31 December 2026, it meets either of the following criteria:
· Employs 250 or more people, and/or
· Has an annual turnover exceeding £44 million and an annual balance sheet total above £38 million
These rules also apply to corporate groups and UK subsidiaries of overseas companies.
What’s involved in an ESOS assessment?
To comply with ESOS, your organisation must appoint an ESOS Lead Assessor recognised by the Environment Agency. The Lead Assessor will:
Measure your total energy consumption
Identify areas of significant energy use, covering at least 95% of total consumption
Carry out compliant energy audits across buildings, transport, and industrial processes
Develop practical recommendations to reduce energy use and improve efficiency
Compile a comprehensive ESOS report
Support board-level sign-off of the report
Assist with submission of the compliance notification to the Environment Agency

When is an ESOS Lead Assessor not required?
An ESOS Lead Assessor is not needed in the following cases:
If your organisation’s total energy consumption during the compliance period is less than 40,000 kWh. In this situation, the assessment must instead be reviewed and signed off by two board-level directors.
If all of your energy use (100%) is covered by a valid ISO 50001 certification. This provides a fully recognised alternative route to compliance, eliminating the need for a Lead Assessor.
Penalties for Non-Compliance
Failing to comply with ESOS can lead to serious consequences from the Environment Agency, including:
Fixed penalties of up to £50,000 per infringement (these can accumulate)
Daily fines of up to £500 per day, for up to 80 days
Publication of your non-compliant status on the Government’s website
Enforcement notices requiring immediate corrective action
Penalties can be triggered by failing to carry out energy audits, maintain proper records, or submit a compliance notification by the deadline. Complying proactively is far more cost-effective than facing fines or reputational damage.
Who is exempt from ESOS?
Organisations below the financial and staffing thresholds outlined earlier are not required to comply.
Certain public bodies are also exempt if they are classified under the Public Contracts Regulations 2015 (or Scottish equivalents) and do not operate as an “undertaking”, meaning they are not engaged in economic or commercial activity. Examples include:
Local authorities
NHS trusts
Government departments
Most universities and publicly funded schools
However, public sector organisations may still need to comply if:
They operate trading arms or subsidiaries of public bodies, and
These entities meet the ESOS criteria for large undertakings (e.g., 250+ employees, £44m+ turnover, £38m+ balance sheet total)
Such subsidiaries are considered “undertakings” and must comply with ESOS unless they are fully covered by an ISO 50001-certified energy management system.
